Eunoia Freediving – Terms & Conditions
1. Agreement
By accessing our website, making a booking, or participating in any Eunoia Freediving activity, you confirm that you have read, understood, and agree to these Terms & Conditions. If you do not agree, you should not book or participate in our services.
2. Participation & Eligibility
Participants must be 18 years or older. Participants aged 12–17 may participate with written consent from a parent or legal guardian.
All participants must complete a medical questionnaire and liability waiver before entering the water with Eunoia Freediving. Once completed, these documents remain valid for future sessions unless your medical status changes.
If any medical conditions are disclosed, we may require medical clearance prior to participation. Failure to provide required documentation before a scheduled session may result in cancellation without refund.
3. Fitness to Participate
By booking, you confirm that you are physically and mentally fit to participate in freediving activities and agree to inform us of any changes to your health, fitness, or medication prior to each session.
4. Safety & Risk Acknowledgement
Freediving involves inherent risks. By participating, you acknowledge and accept all risks associated with freediving, including but not limited to physical injury, illness, or death.
You agree to follow all safety instructions provided by Eunoia Freediving instructors at all times. We reserve the right to exclude any participant from an activity if safety protocols are not followed.
5. Bookings & Payments
Bookings are confirmed once payment has been received and availability has been confirmed by us. All prices are in Australian Dollars and include GST unless otherwise stated. We reserve the right to refuse or cancel bookings at our discretion.
6. Cancellations by Participants
Courses
• 14+ days before start: full refund
• 7–13 days before start: reschedule or refund less a $100 cancellation fee
• Less than 7 days: no refund or rescheduling
Depth Training Sessions
• 72+ hours before start: reschedule
• Less than 72 hours: no refund or transfer
Pool Training Sessions
• 48+ hours before start: reschedule
• Less than 48 hours: no refund or transfer
Pool & Depth Training Bundles: All pool and depth training bundle sessions are issued to the named participant only and are non-transferable. Unused sessions cannot be transferred, sold, or shared with any other person. Sessions are non-refundable. The same cancellation policy applies for booked sessions
Trips & Retreats
• 8+ weeks before start: refund if the spot can be filled, or credit (less any non-refundable deposit)
• 6–8 weeks: 50% credit only
• Less than 6 weeks: no refund
All timeframes are strict and apply regardless of illness, injury, or personal circumstances.
7. Cancellations or Changes by Eunoia Freediving
We may cancel or modify activities due to weather, ocean conditions, safety concerns, instructor availability, or other unforeseen circumstances. If we cancel (excluding force majeure events), you may choose a refund or a credit valid for 12 months. We are not responsible for additional costs such as travel, accommodation, or loss of income.
8. Trips & Travel Insurance
Participants attending trips or retreats must hold appropriate travel insurance, including medical and evacuation cover. If a trip is cancelled due to a force majeure event, costs should be claimed through your insurance provider.
9. Non-Transferable Bookings
All bookings and session bundles are issued to the named participant only and are non-transferable. Unused sessions cannot be carried over beyond their stated validity period.
10. Conduct
Participants are expected to behave respectfully toward instructors, staff, other participants, and the marine environment. We reserve the right to refuse service or remove any participant whose behaviour is unsafe, disruptive, or inappropriate, without refund.
11. Media
Photos and videos may be taken during sessions for training or promotional purposes. If you do not wish to appear in such media, you must notify us in writing prior to your session.
12. Website Use
All content on this website is the property of Eunoia Freediving and may not be copied, reproduced, or used for commercial purposes without written permission.
13. Liability
To the maximum extent permitted by law, Eunoia Freediving is not liable for any loss, injury, or damage arising from participation in our services, except where liability cannot be excluded under Australian Consumer Law.
14. Privacy
We respect your privacy. Personal information collected will be used solely for the purpose of providing our services and will not be shared with third parties without consent.
15. Changes to Terms
We may update these Terms & Conditions from time to time. The version in effect at the time of booking will apply.
16. Governing Law
These Terms & Conditions are governed by the laws of New South Wales, Australia.
